Terms and conditions of sale
Purpose
These terms and conditions govern sign-up for and use of the Fidamail service, an online service provided by Amelys Ltd ("the Publisher"). Signing up constitutes acceptance of these terms.
Description of the service
Fidamail verifies email addresses and states, for each one, whether it is deliverable and for what reason, with flags alongside where applicable. The service is available online and through an application programming interface (API).
Account
Access to the service requires creating an account. The customer warrants the accuracy of the information provided, keeps their credentials and API keys confidential, and remains responsible for activity carried out from their account.
Credits, pricing, and billing
The service works on usage, with no subscription and no commitment: the customer buys credits, and one credit corresponds to one verified address. The price list that applies is the one shown on the site at the time of purchase.
Every verdict returned is billed, whatever it is — deliverable, undeliverable, or set aside on a matter of form: the customer asked a question and got an answer.
What we could not verify is not billed. When a verification does not succeed, we retry at our own expense; if we fail all the same, the credit is refunded to the customer's account.
VAT. Payments are processed by LemonSqueezy (merchant of record) or directly by Amelys Ltd. When LemonSqueezy processes the payment, it is the seller: it issues the invoice and charges the VAT due in the customer's country. When Amelys Ltd processes the payment (card, bank transfer), it is not subject to VAT: the invoice is issued exclusive of tax.
Order of processing
Lists are processed according to the priority class chosen. The Publisher commits to an order of processing, never to a time limit: no processing time is guaranteed.
Customer obligations
The customer undertakes to use the service lawfully. The customer warrants that it has a legal basis for submitting the addresses it entrusts for verification, and remains the controller for them.
The service must not be used to build or validate lists intended for unsolicited mailings.
Accuracy of verdicts
Verdicts are provided as is, as an aid to decision-making. Each one carries its reason and a level of confidence. The Publisher does not guarantee that an address reported as deliverable will remain so, or that a later mailing will get through.
Availability
The Publisher works to keep the service available, without guaranteeing uninterrupted operation. Interruptions for maintenance may occur.
Professional use
The service is offered exclusively to businesses and professionals acting in the course of their trade, business, craft or profession. The customer warrants that it does not contract as a consumer.
Liability
To the extent permitted by law, the Publisher's liability is limited to direct and foreseeable damage, capped at the amounts paid by the customer over the preceding twelve (12) months. Nothing in these terms limits liability that cannot lawfully be limited.
Personal data
The processing of personal data is described in the Privacy policy, which forms an integral part of these terms. It stands as the processing agreement within the meaning of article 28 of the GDPR for the addresses submitted for verification.
Governing law and disputes
These terms are governed by the law of England and Wales, whose courts have exclusive jurisdiction.
